Terms & Conditions

By accessing and using the Rentier website at rentiernyc.com, you are accepting and consenting to the practices in these terms of use. Rentier reserves the right to change these terms and conditions from time to time at its sole discretion.

Definitions

In these Terms of Use “you” and “your” refer to all users of this Website and "Rentier" (“we’, “us” and “our”) refers to Rentier NYC. References to users must be read as being also a reference to customers of www.rentiernyc.com.

LEGALLY BINDING Contract

These Terms of Use constitute a binding legal contract between you and Rentier. These Terms of Use apply to you whether you are browsing or are a customer of Rentier. The Terms of Use in force at any time are published on the Website and you will be taken to have accepted them by accessing or using the Website. If Rentier develops revised terms of use then on their publication on the Website they will supersede those they replace. If you subsequently access or use the Website you will be taken to have accepted the revised terms of use. Specific Website offerings, incentives, areas, or sections may also have additional guidelines which govern your use of this Website. You must comply with them in addition to these Terms of Use.

This agreement contains all of the terms and conditions regarding your rental of products from Rentier via the website www.rentiernyc.com You agree that Borrowing from our business is subject to all our website terms and conditions of use and privacy policy. These are available on our website and are subject to change from time to time. You agree that you are renting products and ownership of the product remains with Rentier at all times. Products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor. By clicking “I accept” rental agreement button you represent that you are over 18 years and are authorized to use the chosen method of payment with the purpose of renting the products on the order.

Documenting the Condition

Before every Borrow, Rentier will take multiple clear and detailed time stamped pictures of the item documenting its current condition before shipping out to the Borrower. These pictures will be referenced as the base condition of the item and compared to images of the return condition in the case of damages.

Shipping

Rentier will ship out via USPS or another carrier and document the drop off with a time stamped tracking receipt. The Borrower will have access to the tracking. If the order arrives late without prior consent from the borrower, borrower is entitled to a full refund given that the item is shipped back within 12 hours of timestamped receipt.

Minor Damages

In the event of a minor damage, Borrowers are required to pay the repair cost of the item to compensate Rentier. Minor Damages include but are not limited to stains, rips, snags, missing decorative items, broken zippers, and/or other minor damages. Wear and tear due to general use of the item is not constituted as a minor damage and is to be expected. The compensation value is determined by Rentier and the tailoring firm and whatever resolution Rentier decides will be binding.

Major Damages & Losses 

For excessive damage, irreparable damage, loss, theft, or non-return of the item, the Borrower will be charged the retail value, effectively buying out the item from Rentier. If the item is with Rentier, Rentier will ship it to the Borrower within 3 days. The compensation value is ultimately determined by the Rentier team and whatever resolution Rentier decides will be binding.

 

Wear & Tear

Wear and tear due to general use of the item is not constituted as a minor damage and is to be expected while Borrowing. The item's base condition is reset at the start of each Borrow and is based on the time stamped photos taken before ship out.  Wear and tear occurs overtime, whereas minor damage will be noticeable when compared to the item’s base condition. Minor Damages include but are not limited to stains, rips, snags, missing decorative items, broken zippers, and/or other minor damages. If the item has arrived with major damage, the borrower must notify Rentier and send the item back within 12 hours of receipt for consideration for a full refund. 

 

Return Cleaning

The item should be returned unwashed to avoid accidental damages. Additional costs incurred to clean items such as deodorant, makeup, or drink stains are considered minor damages and will be reported within 3 days to the Borrower.

Management Service

Rentier offers a service to manage the Borrowing process. This service includes handling communication, booking, packing, posting, cleaning, and repairing items.

How it works:

Rentier will ship the item to the Borrower to arrive on the first Borrow day.  Rentier must document the condition of the item with photos before shipping out. The Borrower will return the item to Rentier on the last day of the Borrow period, or next business day if postal office is closed. Upon receipt of the item, Rentier will be responsible for its management.

  

Borrower Policies

Items

All items on Rentier’s website belong to Rentier and are originals of the brands listed. However, Rentier has no guarantee of listing accuracy, item quality, item arrival condition, or cleanliness. All items are cleaned before they are shipped out but wear and tear should be expected of a rental item. If the Borrower has questions about an item it is their responsibility to contact Rentier for more information.

Rental Order Placement

A Borrower can request to Borrow an item by selecting the item, duration and dates directly on the Rentier website. Upon checkout an authorization hold will be placed on the entered payment method.

A Borrower can set their start date a minimum of 1 days for handoff and 3 days for shipping and maximum of 90 days of the current date.

Pricing

The “Total Borrow Price” for the products includes the item price (dependent on duration), and a chosen rate for shipping.

Borrow Period

Borrowers minimum Borrow period is 3 days. Day 1 of the Borrow period begins on the Start Date and the item is expected to be returned on the End Date set by the Borrower upon requesting the item. If an item arrives before the start date the Borrower will not be charged for additional days and the original period still stands. The Borrower has an option to return the borrowed item earlier than the End Date, however there will not be any refund from Rentier.

Late Fees

If the Borrower returns the item late, the Borrower will incur late fees for each day the item is late being returned/shipped back. The late fees calculated as The Total Borrow Price divided by the Borrow Period and multiplied by 1.5x the days the item is late. For example, if The Total Borrow Price is $100 for The Borrow Period of 5 days, the daily rate applied to the late item is $30.

Selecting Dates

Borrowers are recommended to set the start date 1 day before the day they need the item as Rentier cannot guarantee arrival by a certain date or time.

Size & Fit

Rentier does not offer refund for size and fit. For information on size and fit Borrowers can reference the item description, photos, or photos found on the brand’s website. To ask the Rentier a specific question on sizing, Borrowers can reach out via email. By requesting to Borrow an item, the Borrower understands they will not be refunded for size and fit concerns.

Payment

When a Borrower orders a product you authorize Rentier’s processing partner to save your payment information and charge your payment method for your Borrow. In addition to your Borrow, you authorize Rentier to charge your saved payment method up to an amount to 100% of the entire original retail value of the product as set in the “retail value” on the website. Provided we only charge your payment method when you have not upheld your commitment to us as set forth in the agreement below. In the event an invoice is issued for payment for any reason then payment shall be due within seven (7) days of the date of the invoice.

Cancelations

The Borrower is able to cancel up to 7 days before the Borrow Start Date for store credit. Cancellations after the 7th day or after the item is shipped will not be refunded. Order changes or cancelations will be handled via email or SMS.

Rentier is able to cancel the rental order any time before without penalty and the Borrower will be refunded in full.

All purchases from SALE are non-refundable.

Notifications

You will be notified via SMS through the phone number or email provided at checkout for all order updates including order tracking information.

Shipping

Rentier will ship out via USPS or another expedited carrier. Orders will be shipped few days prior to the rental date via expedited service. In some cases, the dresses will be shipped overnight. The Borrower will have access to the tracking via email. If the order arrives late without prior consent from the borrower, borrower is entitled to a full refund given that the item is shipped back within 12 hours of timestamped receipt.

Inability to adhere to this will result in cancellation of the refund and late return fees if returned later than the Borrow end date.

Condition & Cleanliness

Light wear and tear is to be expected.

If an item arrives dirty or damaged in an unwearable condition, the Borrower will be refunded in full and expected to ship the item back within 12 hours of receiving it. Dirty or damaged in an unwearable condition refers to rips, snags, missing decorative items, or broken zippers.

If an item arrives dirty or damaged but is still wearable, the Borrower is not entitled to any refund.

Returns

The Borrower must use the prepaid label that arrived inside the package or emailed by Rentier to ship out the item on or before the stated end date. Rentier will not reimburse for costs associated with shipping such as printing labels and mailing materials, if any.

The Borrower must ship out via The USPS office and document the drop off with a time stamped tracking receipt. Packages lost without a documented tracking receipt will be deemed not returned, this includes, but is not limited to, packages shipped via UPS, FEDEX , USPS drop box, or mailrooms. A not returned item will be charged up to the full retail value of the item. Additional costs incurred by Rentier due to failure to ship from a USPS office will be charged to the Borrower’s payment method, this includes but is not limited to the creation of expedited shipping labels or refunding back to back bookings.

 

Late Returns

A Borrow is deemed late at 11:59 PM 1 day after the Borrow end date. In the event of a late return, the Borrower’s payment method will be charged Late Fees for every additional day after the Borrow end date. After 7 days the item will be deemed stolen and the Borrower’s payment method will be charged the full retail value.

If the Borrower is unable to ship out or will be shipping out late they are required to notify Rentier immediately.

 

Damages, Loss, & Theft

In the event of damage, loss, or theft Rentier reserves the right to charge the Borrower’s payment method up to the retail value of the item. Minor Damages include but are not limited to stains, rips, snags, missing decorative items, broken zippers, and/or other minor damages. If the damage is excessive, beyond repair, no longer wearable, or the item is lost, stolen, or otherwise unable to be returned, then the Borrower’s payment method will be charged the receipt value to the Lender ultimately “buying out” their item. The compensation value is ultimately determined by the Rentier team and whatever resolution Rentier decides will be binding.

Extending borrow period

Borrowers can request an extension to the Borrow period by contacting Rentier or booking it online. If approved, the Borrower’s payment method will be charged the extension amount.

Requesting to purchase

Rentier is a rental platform but will consider resell on a case by case basis. To request to purchase an item contact Rentier.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Rentier and its owners, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenue, arising out of or related to your use or inability to use the rented items. In no event shall Rentier’s total liability exceed the amount paid by the customer for the rental in question.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rentier, its owners, employees, and agents from and against all claims, losses, liabilities, damages, costs, or expenses (including attorney’s fees) arising out of your use of the rented items, any violation of this agreement, or any third-party claim related to your breach of these terms.

DISCLAIMER OF WARRANTIES

All items are provided "as is" and without warranties of any kind, either express or implied. Rentier disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. You assume full responsibility for inspecting items upon receipt.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New York County, New York for any disputes arising out of or relating to these Terms or your use of the services.

ARBITRATION AGREEMENT

Any dispute arising from these Terms or your use of Rentier’s services will be resolved by binding arbitration, rather than in court. The Federal Arbitration Act and federal arbitration law apply to this agreement. Arbitration shall be conducted in New York County, New York.

Territories

Rentier is only available in the United States.
